YARÁ Spa & Skin – Terms & Conditions

1. Introduction

Welcome to YARÁ Spa & Skin. By accessing our website, booking spa services, placing an online order, or using our mobile application, you agree to these Terms & Conditions (“Terms”).

These Terms apply to all clients, customers, users, and visitors of YARÁ Spa & Skin’s digital platforms and services. Please review them carefully. Continued use of our services constitutes acceptance of these Terms.

YARÁ Spa & Skin reserves the right to update or modify these Terms at any time without prior notice. Changes will take effect immediately upon posting.

2. Services & Treatments (In-Person Spa Services)

YARÁ Spa & Skin provides cosmetic skincare treatments, consultations, and non-medical facial services.

By booking a treatment, you acknowledge and agree that:

  • All treatments are cosmetic and wellness-based and do not diagnose, treat, or cure medical conditions.

  • You are responsible for providing accurate information regarding health conditions, allergies, medications, and skin sensitivities.

  • Treatment results may vary based on skin type, lifestyle, and homecare routines.

  • Late arrivals may result in shortened service time without price adjustment.

  • YARÁ Spa & Skin reserves the right to refuse or reschedule services for health, safety, or professional reasons.

3. Online Store & E-Commerce

YARÁ Spa & Skin offers skincare, beauty, wellness, and lifestyle products through its online store.

  • Product descriptions, pricing, and availability are subject to change without notice.

  • We reserve the right to limit or refuse orders at our discretion.

  • Product imagery is for illustrative purposes and may differ slightly from the final product.

4. Dropshipping & Third-Party Fulfillment

Some products sold through YARÁ Spa & Skin are fulfilled by third-party suppliers, including international vendors.

By placing an order, you acknowledge and agree to the following:

Fulfillment Process

  • Products may ship directly from third-party supplier warehouses located worldwide.

  • Estimated shipping times may range from 7–30 business days and are subject to supplier processing, carrier delays, customs clearance, and border inspections.

  • Inventory availability is controlled by third-party suppliers.

Product Variations

  • Minor variations in product color, texture, materials, packaging, or labeling may occur due to manufacturing differences and do not constitute defects.

YARÁ Spa & Skin does not manufacture third-party products and is not responsible for supplier manufacturing processes.

5. Shipping, Delivery & Customs

Estimated Shipping Times

Shipping timelines are estimates only and are not guaranteed.

International Shipments

Orders fulfilled outside Canada may be subject to:

  • Customs duties

  • VAT or import taxes

  • Carrier or border delays

All customs fees and import charges are the responsibility of the customer and are not included in product pricing.

Lost or Delayed Packages

If an order is lost or significantly delayed:

  • YARÁ Spa & Skin will initiate an investigation with the supplier or carrier.

  • Resolution timelines depend on third-party investigations.

  • Refunds or replacements are issued only if approved by the fulfillment partner.

6. Returns & Refunds

Due to the nature of international fulfillment and personal-use products, returns may not always be accepted.

Refunds may be considered in the following cases:

  • Damaged or defective items

  • Incorrect items received

  • Products not delivered within 60 days

Refunds are not issued for:

  • Customer error (incorrect address, change of mind)

  • Delays caused by customs or carriers

  • Minor product variations

7. Referral Program & Radiance Points

YARÁ Spa & Skin offers a referral program that allows existing clients to earn Radiance Points by inviting new clients to book a service.

  • Referral rewards apply only to first-time YARÁ Spa & Skin clients.

  • The referred client receives 150 Radiance Points upon booking their first qualifying appointment.

  • The referring client receives 150 Radiance Points once the referred appointment has been completed.

Radiance Points:

  • Have no cash value

  • Are non-transferable

  • May only be redeemed toward eligible YARÁ services or products

  • Cannot be exchanged for cash or refunded

YARÁ Spa & Skin reserves the right to modify, suspend, or terminate the referral program or adjust point values at any time without prior notice. Misuse of the referral program, including self-referrals or fraudulent activity, may result in forfeiture of points or account suspension.

8. User Responsibilities

You agree not to:

  • Misuse the website, mobile application, or services

  • Attempt to copy, reproduce, or steal proprietary content

  • Engage in fraudulent activity

  • Provide false or misleading information related to bookings, orders, or referrals

9. Intellectual Property

All content on YARÁ Spa & Skin’s website and application—including text, images, branding, logos, graphics, and design—is the exclusive property of YARÁ Spa & Skin and may not be copied, reproduced, or used without prior written consent.

10. Limitation of Liability

To the fullest extent permitted by law, YARÁ Spa & Skin is not liable for:

  • Shipping delays caused by carriers or customs

  • Errors or defects from third-party suppliers

  • Adverse reactions due to undisclosed sensitivities or misuse of products

  • Inaccuracies in supplier-provided product descriptions

  • Any damages exceeding the total amount paid for the product or service

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Alberta and the laws of Canada applicable therein.
